Terms of Service

• “PesaStream”, “we”, “us” — PesaStream Limited, the company providing the service.
• “ProductSafi” — our video-commerce platform (web app, mobile app, and API).
• “Merchant”, “you” — a business or person using ProductSafi to sell.
• “Buyer” — a person paying one of a merchant’s links.
• “Content” — anything you upload: products, images, video, text.

• You must be 18 or older and able to enter a binding contract.
• You must give accurate registration and business details and keep them current.
• You are responsible for activity under your account and for keeping your credentials secure.
• Tell us immediately of any unauthorised access; we may suspend accounts showing fraud or abuse.

• Marketing videos and animated promo cards generated from your product information.
• Hosted pay links and a checkout page with a scannable QR.
• Payment processing through Paystack — M-Pesa STK and card — with settlement to your bank.
• Delivery coordination and proof-of-delivery, and a customer list built from your sales.
• Transactional WhatsApp notifications and analytics on your links and sales.
• A REST API for partners who want to embed the same capabilities.

Limitations

• Generated videos and promos are produced automatically and may not be perfect; we don’t guarantee any particular sales result.
• We depend on third parties (Paystack, Meta WhatsApp, Cloudflare) whose services may occasionally be unavailable.
• We may add, change, or remove features over time.

Our fees

• 4% per sale — a platform fee deducted from each successful payment before your share settles to your bank (handled automatically via the Paystack split).
• KES 300 per video — charged when you generate a marketing video. The amount owed is recovered from your subsequent pay-link settlements.

Other costs

• Paystack’s own payment-processing fees may apply to each transaction.
• Settlement timing follows Paystack’s payout schedule to your linked bank account.

Ownership

• You keep ownership of everything you upload and of the videos generated from it.
• You grant us the licence needed to host, process, and display your content so we can run the service for you.
• We may use de-identified, aggregated data to improve the platform.

You must not

• Sell illegal or prohibited goods, or anything that breaks Kenyan law.
• Upload content that infringes copyright, trademark, or other rights.
• Post misleading, fraudulent, offensive, or discriminatory material.
• Misuse the platform to defraud buyers or evade fees.

• Ours: the ProductSafi platform, software, design, the ProductSafi and PesaStream names and logos.
• Yours: your products, brand, images, customer data, and the videos generated for you.

By you

You can stop using ProductSafi and request account deletion at any time; personal data is removed after a 30-day grace period (see the Privacy Policy).

By us

We may suspend or close an account for breach of these Terms, unpaid fees, fraud or illegal activity, or where required by law — with notice where reasonable.

ProductSafi is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law.

We are not liable for

• Lost revenue, profits, or business, or any indirect or consequential loss.
• Failures of third-party services (Paystack, WhatsApp, Cloudflare).
• Loss caused by compromised credentials on your side.
• The quality or sales performance of generated videos.

Cap

To the extent permitted by law, our total liability is limited to the fees you paid us in the 6 months before the claim.

You agree to indemnify PesaStream against claims arising from your use of the platform, your content, your products and deliveries, or your breach of these Terms or of any law or third-party right.

• These Terms are governed by the laws of Kenya, including the Data Protection Act, 2019.
• Disputes are subject to the courts of Kenya (Nairobi).
• We may update these Terms; significant changes will be notified by email or in-app.
